Welcome to Club Cruise. These Privacy Policy and Terms & Conditions govern your use of our website, your interactions with Worldwide Halo, Inc., doing business as Club Cruise ("Club Cruise"), and the professional travel planning, reservation, and advisory services we provide. Please read this document carefully, as it explains how we collect, use, and protect your information, as well as the terms governing our professional services and your travel arrangements.
These Terms & Conditions ("Terms") constitute a legally binding agreement between Worldwide Halo, Inc., a California corporation doing business as Club Cruise ("Club Cruise," "Company," "we," "our," or "us") and any individual or entity ("Client," "Traveler," or "you") accessing the Company's website, requesting travel planning services, purchasing travel arrangements, submitting payment, or otherwise engaging the Company's professional services.
By accessing the Company's Website, requesting travel planning services, authorizing reservations, submitting payment, or accepting travel documents, you acknowledge that you have read, understand, and agree to be bound by these Terms & Conditions, as amended from time to time.
Club Cruise is a professional travel advisory and reservation management company providing consultation, itinerary planning, supplier coordination, reservation management, documentation guidance, travel support, and related professional services for leisure, luxury, corporate, group, and specialty travel.
The Company acts solely as an intermediary between its Clients and independent third-party travel suppliers. Except where expressly stated in writing, Club Cruise does not own, operate, control, manage, or provide any airline, cruise line, hotel, resort, transportation service, tour operation, excursion, travel insurance policy, or other travel product purchased by a Client.
The Company provides professional knowledge, research, planning, coordination, advocacy, and administrative services intended to assist Clients in arranging travel. The Company's responsibilities are limited to those professional services expressly undertaken by the Company.
Club Cruise provides professional travel advisory services that extend substantially beyond the placement of reservations. Clients engage the Company for its professional experience, industry relationships, destination knowledge, supplier expertise, and ongoing support throughout the travel planning process.
Professional services may include destination consultation, itinerary development, supplier evaluation, travel research, fare analysis, promotional review, supplier negotiations, reservation management, documentation guidance, payment administration, travel insurance facilitation, coordination of special requests, monitoring of reservation changes, assistance before, during, and after travel, and other advisory or administrative services reasonably necessary to support a Client's travel arrangements.
Professional services begin immediately upon the Company's acceptance of a Client's request for assistance and continue throughout the planning process regardless of whether travel is ultimately completed.
The Client acknowledges that the professional services provided by Club Cruise possess independent value separate and apart from any commissions or compensation paid by travel suppliers.
Club Cruise provides professional travel planning, consultation, itinerary development, supplier research, reservation management, fare monitoring, documentation guidance, supplier coordination, and ongoing travel support before, during, and after travel. These professional services require substantial advisor time, industry expertise, administrative resources, and professional judgment, and they begin immediately upon the Company's acceptance of a Client's request for assistance.
The Client acknowledges and agrees that the professional services provided by Club Cruise possess substantial independent value separate and apart from any commission, incentive, override, or other compensation paid by travel suppliers. Such professional services are performed regardless of whether travel is ultimately booked, completed, or cancelled, and the value of those services is not dependent upon the Company's receipt of supplier compensation.
From time to time, Club Cruise may assess professional service fees for specialized services, complex itinerary planning, extensive consultation, administrative requests, or other services requiring substantial additional advisor time. Any such fees will be communicated to the Client before they are assessed.
If a Client voluntarily cancels a reservation after substantial professional services have been performed, and such cancellation results in reduced, forfeited, or eliminated supplier compensation to Club Cruise, the Company reserves the right to assess a Cancellation Service Fee to compensate for professional services already rendered.
Unless otherwise agreed in writing, the Cancellation Service Fee begins at $250.00 per traveler and may increase depending upon the complexity of the itinerary, the professional services performed, advisor time invested, supplier coordination required, itinerary revisions requested, administrative work completed, and the overall scope of the engagement.
The Client acknowledges and agrees that the Cancellation Service Fee represents reasonable compensation for professional services previously rendered by Club Cruise and is not a cancellation penalty imposed by any travel supplier. The Cancellation Service Fee is separate from and in addition to any cancellation penalties, supplier administrative charges, airline fees, cruise line penalties, hotel charges, insurance premiums, or other amounts imposed by independent travel suppliers.
In the event a reservation is cancelled due to illness, injury, death, or another event that may be covered under a travel insurance policy, Club Cruise will, upon request, provide copies of invoices, reservation confirmations, cancellation notices, and documentation reflecting applicable supplier cancellation penalties and any Cancellation Service Fee assessed by the Company, to the extent such records are available. These documents may be submitted by the Client to the applicable travel insurance provider as part of the Client's insurance claim. Club Cruise does not prepare, submit, administer, negotiate, or guarantee insurance claims or reimbursement, and the provision of such documentation does not guarantee claim approval.
All coverage determinations, claim decisions, and reimbursements remain solely within the discretion of the issuing travel insurance provider and are subject to the terms, conditions, limitations, and exclusions of the applicable policy.
The Company reserves the sole discretion to waive, reduce, or not assess a Cancellation Service Fee in any particular circumstance. Nothing contained in these Terms shall obligate Club Cruise to impose a Cancellation Service Fee in every instance.
Clients are responsible for reviewing all quotations, invoices, reservation confirmations, travel documents, itineraries, supplier terms, cancellation schedules, payment deadlines, and other materials provided by Club Cruise immediately upon receipt.
The Client shall promptly notify Club Cruise of any errors, omissions, discrepancies, spelling errors, incorrect travel dates, passenger information, pricing concerns, or other inaccuracies. Failure to promptly identify such errors may result in additional supplier fees, penalties, loss of reservations, or denial of travel, for which Club Cruise shall bear no responsibility.
The Client further acknowledges responsibility for ensuring that all travelers possess valid passports, visas, government-issued identification, vaccination records, travel authorizations, and any other documentation required by the applicable governmental authorities or travel suppliers.
Failure to obtain or present required documentation shall not constitute grounds for refund, cancellation without penalty, or liability on the part of Club Cruise.
All travel quotations are provided subject to availability and may be withdrawn or modified by the applicable travel supplier without prior notice. Pricing is not guaranteed until reservations have been confirmed by the supplier and all required deposits have been timely received and accepted.
Travel suppliers maintain exclusive control over pricing, inventory, promotional offers, airfare availability, taxes, governmental fees, fuel surcharges, port charges, exchange rates, and other components affecting the total cost of travel. Accordingly, Club Cruise cannot guarantee the continued availability of any quoted fare, promotion, cabin category, airfare, itinerary, or pricing until confirmed by the applicable supplier.
The Company reserves the right to correct typographical errors, pricing inaccuracies, supplier errors, or inadvertent omissions at any time prior to final confirmation of the reservation.
The Client acknowledges that all deposits, installment payments, final payments, and other amounts due are governed by the terms and conditions established by the applicable travel supplier unless otherwise expressly stated in writing by Club Cruise.
Payment authorization provided by the Client, whether verbally, electronically, in writing, or through an approved authorization form, constitutes authorization for Club Cruise to process payment for the travel services identified by the Client. The Client represents that he or she is an authorized user of the payment method provided and authorizes Club Cruise and, where applicable, the travel supplier to charge the approved payment method for all authorized amounts.
Failure to make payments by the applicable due dates may result in cancellation of reservations, loss of promotional pricing, cancellation penalties, additional supplier fees, or forfeiture of deposits. Club Cruise shall have no responsibility for losses resulting from a Client's failure to make timely payments.
Unless otherwise required by law, all deposits paid to travel suppliers are subject to the supplier's refund policies and cancellation provisions.
The Client agrees that any concerns regarding reservations, services, billing, or supplier performance shall first be presented directly to Club Cruise in good faith to allow an opportunity for review and resolution before initiating a chargeback or payment dispute.
The Client acknowledges that many payments processed by Club Cruise are immediately remitted to independent travel suppliers and are no longer within the possession or control of the Company. Accordingly, initiating a chargeback does not reverse or cancel supplier obligations, reservations, or cancellation penalties.
Improper chargebacks relating to authorized travel purchases, Professional Service Fees, Cancellation Service Fees, or other authorized charges may constitute a breach of these Terms. Club Cruise reserves the right to pursue recovery of unpaid amounts, collection costs, reasonable attorneys' fees where permitted by law, and any additional damages available under applicable law.
Nothing contained herein limits a Client's rights under applicable consumer protection laws.
Following confirmation of a reservation, any request to modify travel dates, traveler names, accommodations, cabin categories, airfare, hotels, tours, transportation, destinations, suppliers, or other material components of the reservation shall be subject to availability, supplier approval, and any applicable supplier fees.
Club Cruise may assess additional Professional Service Fees for substantial post-booking modifications requiring additional advisor time, supplier coordination, itinerary reconstruction, or administrative work. Such fees are separate from any charges imposed by travel suppliers.
The Company does not guarantee that requested modifications can be accommodated and assumes no responsibility for increased pricing, reduced availability, loss of promotional offers, or other consequences resulting from requested changes.
Requests to cancel travel must be communicated directly to Club Cruise during normal business hours or submitted in writing. Cancellation requests are not effective until acknowledged by the Company.
Cancellation penalties are established exclusively by the applicable travel supplier and may vary based upon the supplier, destination, travel dates, promotional offers, and the timing of cancellation. Club Cruise has no authority to waive, modify, negotiate, or override supplier cancellation policies.
In addition to supplier cancellation penalties, any applicable Cancellation Service Fee or other previously disclosed professional service fee shall remain due in accordance with these Terms.
Refund eligibility, if any, shall be determined solely by the applicable supplier. Processing times for approved refunds are controlled by the supplier and the financial institution involved and are outside the Company's control.
Club Cruise strongly recommends that every traveler purchase comprehensive travel insurance.
Travel insurance is issued, underwritten, administered, and interpreted exclusively by independent third-party insurance providers. Club Cruise is not an insurance company, insurance producer, claims administrator, adjuster, or representative of any insurance carrier.
The Company's role is limited to facilitating the purchase of travel insurance products offered by independent providers. Club Cruise does not guarantee coverage, interpret policy provisions, determine eligibility, approve claims, deny claims, negotiate settlements, or make representations regarding the scope of insurance benefits beyond the information supplied by the issuing insurer.
Questions regarding policy coverage, exclusions, benefits, limitations, claim procedures, reimbursement, or policy interpretation must be directed exclusively to the issuing insurance provider.
Club Cruise does not prepare, submit, administer, negotiate, monitor, expedite, appeal, or otherwise manage insurance claims on behalf of Clients. While the Company may, as a courtesy and at its sole discretion, provide copies of invoices, confirmations, itineraries, or other documents reasonably available within its records, the preparation, accuracy, submission, and follow-up of any insurance claim remain solely the responsibility of the traveler.
The purchase of travel insurance does not guarantee reimbursement for any loss. All claims are subject solely to the terms, conditions, exclusions, limitations, and claim determination procedures established by the issuing insurance provider.
Clients who decline travel insurance acknowledge that they assume all financial risks associated with cancellation, interruption, delay, medical expenses, emergency evacuation, supplier default, baggage loss, and other unforeseen events. By declining travel insurance, the Client releases Club Cruise from any responsibility arising from uninsured losses or denied insurance claims.
Nothing contained herein shall be construed as legal, medical, tax, financial, or insurance advice. Clients are solely responsible for reviewing policy documents and determining whether any insurance product adequately meets their individual needs.
Each traveler is solely responsible for obtaining and maintaining a valid passport, visa, government-issued identification, vaccination documentation, travel authorization, or any other documentation required by the destination country, airline, cruise line, or governmental authority.
Passport validity requirements vary by destination, and many countries require passports to remain valid for at least six (6) months beyond the date of return. Clients are responsible for verifying all documentation requirements prior to travel.
Club Cruise may provide general information regarding travel documentation as a courtesy; however, such information is subject to change without notice and should not be relied upon as legal or governmental advice. The Company assumes no responsibility for denied boarding, refusal of entry, missed travel, additional expenses, or other losses resulting from insufficient, expired, inaccurate, or missing travel documentation.
The Client is solely responsible for determining his or her medical fitness for travel and for consulting qualified medical professionals regarding any health concerns, vaccinations, medications, mobility limitations, dietary requirements, or other personal circumstances that may affect travel.
Although Club Cruise will make reasonable efforts to communicate special requests to applicable travel suppliers, the Company cannot guarantee that any supplier will be able to accommodate such requests.
Clients requiring mobility assistance, medical equipment, accessible accommodations, oxygen, dialysis, service animals, dietary accommodations, or other special arrangements are responsible for advising Club Cruise at the earliest possible opportunity. The Company shall not be liable for a supplier's inability or refusal to accommodate special requests.
